Please read these Terms of Service carefully before using the Pacific Concepts Group website or engaging PCG for sales, service, or support. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Pacific Concepts Group (“PCG,” “we,” “us,” or “our”) is an authorized DIRECTV for Business dealer and authorized STARLINK reseller via DSI Systems Inc headquartered in Long Beach, California. These Terms govern your use of our website at pcgroupinc.com and your engagement with PCG for product sales, account setup, and service support.

1. Acceptance of Terms

By accessing and using the Pacific Concepts Group website (the “Site”) or by requesting products or services from PCG, you accept and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a binding legal agreement between you and PCG. If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Services Provided by PCG

Pacific Concepts Group provides the following services as an authorized dealer and reseller:

• Sales and account setup for DIRECTV for Business, including commercial programming packages for commercial venues.
• Sales and provisioning for STARLINK business service plans, including fixed-site, maritime, and land mobile connectivity solutions via DSI Systems Inc.
• Equipment recommendation, configuration guidance, and installation coordination for DIRECTV and STARLINK hardware.
• Ongoing commercial account support and service coordination.

PCG acts as an authorized sales agent and reseller for DIRECTV and STARLINK via DSI Systems Inc. PCG does not provide, operate, or maintain the underlying satellite TV or internet services themselves. Once your service account is established, your ongoing service, billing, and technical support relationship for DIRECTV is governed by DIRECTV’s terms of service, and for STARLINK by DSI Systems Inc terms of service. PCG is not a party to those agreements and is not responsible for service performance, outages, or billing disputes with those providers.

3. Use of Website

You may use our Site for lawful purposes only. You agree not to use the Site:

• In any way that violates any applicable federal, state, local, or international law or regulation.

• To transmit or procure the sending of any unsolicited advertising or promotional material without our prior written consent.
• To impersonate or attempt to impersonate PCG, a PCG employee, another user, or any other person or entity.
• To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site.
• To attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site.
• To use any automated means, including robots, crawlers, or data mining tools, to extract data from the Site without our written consent.

4. Intellectual Property Rights

The Site and its original content, features, and functionality are and will remain the exclusive property of Pacific Concepts Group and its licensors. The Site is protected by copyright, trademark, and other applicable laws of the United States and other jurisdictions.

The PCG name, logo, and all related marks are trademarks of Pacific Concepts Group. DIRECTV and related marks are trademarks of DIRECTV, LLC. STARLINK and related marks are trademarks of Space Exploration Technologies Corp. These marks may not be used in connection with any product or service without the prior written consent of the respective trademark owner.

Nothing in these Terms grants you any right, title, or interest in PCG’s intellectual property or in the trademarks or intellectual property of DIRECTV or STARLINK.

5. Quotes, Orders, and Pricing

All pricing, availability, and product configurations provided by PCG are subject to change without notice and are contingent on availability from the applicable provider (DIRECTV or STARLINK) at the time of order.

Quotes provided by PCG are estimates based on information provided by you and current program availability. Final pricing is subject to confirmation at the time of order. PCG reserves the right to correct any pricing errors prior to fulfillment.

PCG does not process billing or collect payments for DIRECTV or STARLINK service subscriptions. All subscription fees, service charges, and billing for those services are handled directly by the respective providers under their own billing terms. PCG may charge separately for equipment, installation coordination, or professional services provided directly by PCG, where applicable.

6. Account Setup and Customer Responsibilities

By engaging PCG to set up a DIRECTV for Business or STARLINK account on your behalf, you authorize PCG to submit your business and contact information to the applicable provider for the purpose of establishing your service account.

You are responsible for:

• Providing accurate and complete information when requesting service or a quote.
• Ensuring that any equipment installations at your facility comply with applicable building codes, lease agreements, and local regulations.
• Reviewing and agreeing to the terms of service of DIRECTV or STARLINK directly, as your ongoing service is governed by those agreements.
• Notifying PCG promptly of any changes to your business information, service address, or account requirements.

7. Third-Party Products and Services

The products and services PCG sells — including DIRECTV for Business and STARLINK — are provided by third-party providers. PCG makes no warranties or representations regarding the performance, availability, or reliability of these third-party services.

Any claims, disputes, or concerns related to the underlying DIRECTV or STARLINK service — including service quality, outages, billing, or contract terms — must be directed to the applicable provider. PCG will make commercially reasonable efforts to assist in resolving service issues on your behalf as your authorized dealer, but PCG is not liable for the acts, omissions, or failures of DIRECTV, STARLINK, or any other third-party provider.

Our Site may contain links to third-party websites as a convenience. PCG has no control over the content of those sites and is not responsible for their content, privacy practices, or terms of use.

8. Prohibited Uses

In addition to the restrictions in Section 3, you may not use our Site or services:

• For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
• To violate any international, federal, state, or local laws, regulations, rules, or ordinances.
• To infringe upon or violate the intellectual property rights of PCG, DIRECTV, STARLINK, or any other party.

• To submit false, misleading, or fraudulent information to PCG or to any provider on whose behalf PCG is acting.

• Any products or services sold by PCG, including DIRECTV for Business or STARLINK services provided by third-party providers.

PCG’s total liability to you for all claims arising out of or related to these Terms, the Site, or any services provided by PCG shall not exceed the total amount you paid directly to PCG for the specific products or services giving rise to the claim in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, PCG’s liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Pacific Concepts Group and its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

• Your violation of these Terms.
• Your use of the Site or PCG’s services in a manner not authorized by these Terms.
• Any false or misleading information you provide to PCG.
• Your violation of any third-party rights, including intellectual property or privacy rights.

13. Termination

PCG may terminate or suspend your access to the Site or our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Site and PCG’s services will cease immediately.

Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers of warranties, limitations of liability, and governing law — shall survive termination.

14. Changes to Terms

PCG reserves the right, at its sole discretion, to modify or replace these Terms at any time. 15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site or PCG’s services shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

Before initiating any formal legal proceeding, you agree to contact PCG in good faith to attempt to resolve the dispute informally. PCG will use commercially reasonable efforts to address and resolve your concern within 30 days of receiving written notice of the dispute.

16. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements between you and PCG, constitute the entire agreement between you and Pacific Concepts Group with respect to the subject matter herein and supersede all prior and contemporaneous agreements, representations, and understandings.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. PCG’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
